Your Rights Under NZ Consumer Law
Orangetheory membership agreements are covered by NZ Consumer Law. Monthly members have the right to cancel with 30 days notice at any time. If Orangetheory attempts to charge beyond your confirmed cancellation date, you have the right to dispute those charges with your bank and file a complaint with the Commerce Commission.
The NZ Commerce Commission has guidance on unfair contract terms — gym contracts that automatically roll over without clear notice, or that charge excessive cancellation fees, may fall foul of the Fair Trading Act 1986. If you believe you're being charged unfairly, contact the Commerce Commission or lodge a dispute with the Disputes Tribunal (free to use for claims under $30,000).
Common Problems and How to Handle Them
- App shows 'cancel online' but it doesn't complete — always follow up with a direct email to your studio. App cancellations are not always processed.
- Studio says you need to attend in person — you are entitled to cancel in writing. Email is sufficient and provides you with a legal record.
- Heart Rate Monitor (HRM) device not returned — if you rented an Orangetheory HRM, return it before your last session to avoid a replacement fee ($50–$80).
- Corporate membership cancellation — if your membership is through an employer, contact both Orangetheory and your employer's HR/benefits team.
