Your Rights Under NZ Consumer Law
F45 memberships are covered by the Consumer Guarantees Act 1993 and Fair Trading Act 1986. Because F45 is a franchise, membership terms vary between studios — this means your contract is with the studio operator, not F45 Training globally. If a studio charges fees not disclosed in your agreement, this may be a Fair Trading Act breach.
The NZ Commerce Commission has guidance on unfair contract terms — gym contracts that automatically roll over without clear notice, or that charge excessive cancellation fees, may fall foul of the Fair Trading Act 1986. If you believe you're being charged unfairly, contact the Commerce Commission or lodge a dispute with the Disputes Tribunal (free to use for claims under $30,000).
Common Problems and How to Handle Them
- Studio says cancellation must be in person — you have the right to cancel in writing. Send via email and request written confirmation.
- Studio is unresponsive — escalate to F45 Training NZ's national contact. If still no response, contact your bank to dispute further charges.
- Studio closed down — if your F45 studio has closed, contact your bank immediately to cancel the direct debit. You are not obligated to pay for services not delivered.
- Charged after cancellation — if a charge occurs after your confirmed cancellation date, contact your bank to reverse the transaction and send the gym your written confirmation as evidence.
